Unfortunately, applications are often refused by the Home Office. Reasons for refusal can be things like providing insufficient supporting evidence, or the wrong type of supporting evidence, or incorrect information with the application. Common examples include the Home Office not being satisfied that a relationship is genuine, that a financial requirement has been met, that a sponsor or applicant’s employment is genuine, that someone has established a sufficiently strong family or private life in the UK, that someone is seeking to come to the UK as a genuine visitor or that there is a threat of persecution or serious harm if a person is returned to their country of origin. Even minor errors can allow the Home Office to say that an applicant does not meet the requirements of the Immigration Rules and refuse the application.

Appeals to the First-tier Tribunal are lodged by submitting a Notice of Appeal which must set out the grounds of appeal. If you are in the UK, the deadline for submitting your Notice of Appeal is quicker than if you are abroad. If you miss the deadline then you may not be able to appeal the decision at all.
The Home Office does not grant a right of appeal. A right of appeal arises by operation of law. This means that the only Home Office decisions which can be appealed are those that are described by statute as carrying the right of appeal, for example, a refusal of an asylum or human rights claim. This is why it is important for you to know whether you have a right of appeal otherwise the consequence might be that you fail to challenge a Home Office decision where you have the right to do so.
The Immigration (Notices) Regulations 2003 require that the Home Office issues a Notice of Decision, where the decision is appealable, with an accompanying statement explaining the right of appeal. Where there is an in country right of appeal, the Notice of Decision must be accompanied by a Notice of Appeal. A Notice of Decision which does not conform to the Notices Regulations may be invalid. Regardless of the validity of the notice though, if the Home Office has in fact made an appealable immigration decision, an immigration Judge will have jurisdiction to deal with the appeal. Even if a Home Office decision letter does not mention the right of appeal, the Tribunal has the power to determine its own jurisdiction and confirm your right of appeal.
