Leave to remain partner

If you are married to or the partner of a British or Irish citizen or someone who is settled in the UK, you may be eligible to remain in the UK with them.

A visa granted on the basis of being a spouse or partner will give you the right to live, work and study in the UK for a period of two years and nine months, with the option to apply to extend the visa at the end of this period.

Applying for a UK visa as a partner

Eligibility

To be eligible to apply for a UK partner visa, your partner must be either:

  • A British or Irish citizen;
  • Hold settled status in the UK such as indefinite leave to remain;
  • Be from the EU, Switzerland, Norway, Iceland or Liechtenstein and have pre-settled status;
  • Have a Turkish Businessperson visa or Turkish Worker visa; or
  • Have refugee status or humanitarian protection in the UK

You may also need to provide evidence showing that you have the necessary standard of English. You will need to show that you can support yourself financially.

Evidence of your relationship

The Home Office will need to see documents showing that you meet the criteria in respect of your relationship. You will need to prove that either:

  • You are in a marriage or civil partnership that is recognised in the UK
  • You have been living together for a minimum of two years
  • You are engaged to marry or enter into a civil partnership and will do this within six months of arriving in the UK

Evidence needed to support an application for leave to remain as a partner

You will generally need to provide the results of an approved English language test to show that you have an adequate standard of English, unless you are from certain English-speaking countries or hold a degree that was taught in English or are otherwise exempt from the English language requirement.

Documents need to be provided to show that you are in a valid relationship. This could include:

  • Your marriage certificate or civil partnership certificate
  • A tenancy agreement or bills from utility companies or the local authority addressed to you both at the same address
  • A bank statement for a joint bank account confirming that you both live at the same address
  • A letter from the doctor or dentist who treats you both and who can confirm you are both registered with the same address

The documents should be from sources such as government departments, banks, a landlord and utility companies and should not be more than four years old.

If you are not able to supply the above evidence, we can go through the documents that you do have to support your application. While other paperwork may not be as valuable, it may still be possible to satisfy the authorities and obtain a partner visa.
