Your correspondence from UK Visas and Immigration should tell you whether or not you can appeal. Even if you are not able to appeal, you may be entitled to request an administrative review or a judicial review of the decision, depending on the circumstances of your case.

When can you appeal to the First-tier Tribunal (Immigration and Asylum Chamber)?
The First-tier Tribunal (Immigration and Asylum Chamber) is the first level of court to which you can appeal an immigration decision. You can generally appeal if you have had:
- Refusal of a protection or asylum claim
- Protection status revoked
- Refusal of a human rights claim
- Refusal of residence documentation or deportation
- British citizenship revoked
- Refusal or revocation of your status or varying length or conditions of your stay under the EU Settlement Scheme
- Refusal or revocation of your travel permit or family permit or restriction of your rights to enter the UK under the EU Settlement Scheme
- Refusal or revocation of your permit or deportation as a frontier worker
Refusal or revocation of your leave or deportation as an S2 healthcare visitor
Deadline for immigration appeals
You will usually have only 14 days from the date on which your decision was sent to you in which to appeal. If you are outside the UK then your appeal deadline is 28 days. If you miss this date, you should speak to a solicitor about appealing after the deadline. This may be possible, but you will need to put forward a strong argument as to why the deadline was missed and why you should be permitted to appeal out of time.
Grounds for making an immigration appeal
There are four grounds on which an appeal can be made, depending on the type of decision which has been refused or the right which has been revoked, namely:
- Rights under EU treaties or the EU withdrawal scheme have been breached
- Human rights have been breached
- The UK’s obligations under the Refugee Convention have not been observed
- The UK’s obligation to grant humanitarian protection has not been observed

Upper Tribunal immigration appeals
