If you have been refused a visa or your visa application has been rejected, you may still be able to secure a visa by lodging an appeal. It is important to move quickly because there are short deadlines by which you must act. It is also vital to ensure that your appeal is accurate and that you follow the correct procedure.
At Saxon Solicitors, our highly experienced immigration appeals solicitors in Manchester regularly represent clients who have had their visa applications denied. We can go through your application for you and identify any issues that need to be dealt with.
If you ask us to represent you, we will advise you of the best way to proceed and put together a robust appeal on your behalf, giving you the best possible chance of success.
UK visa refusal appeals process
If your UK visa application is refused or rejected, you will be advised of the reasons and you may be told that you have one of the following rights:
- The right to make an appeal
- The right to request an administrative review of the decision
- No right to appeal
You will usually have 14 days from the date that your decision was sent in which to start your appeal, so you need to act quickly. If you have missed the deadline, you should speak to an immigration solicitor as soon as you can. It may still be possible to make an appeal, but you will have to explain why the deadline was missed.
The appeal should be made online where possible. If you have a solicitor representing you, they will be able to use the government’s MyHMCTS service. This involves completing an appeal form and including all relevant documents to support your appeal. It is crucial to ensure that you have sufficient evidence to accompany your appeal.
The appeal may be decided on the basis of the documents provided or there could be a hearing. If there is a hearing, you should ensure that you are represented by a genuine expert in immigration appeals. Our Manchester immigration appeals lawyers frequently deal with this type of hearing and have an excellent track record of success.
Grounds for appeal of UK visa application refusal
There are several possible grounds for appealing a visa application refusal. If you are not sure which applies in your case, you are advised to speak to an immigration appeals solicitor who will be able to identify the best appeal route for you. Possible routes of appeal include:
- The decision does not comply with immigration rules
- The decision does not comply with the law
- The discretion used in making the decision should have been exercised differently
If you or your lawyer can show at the appeal stage that all the visa requirements have been met, then your appeal will succeed.
Request an administrative review of your visa refusal or rejection
If you believe that an administrative error was made in dealing with your visa application which resulted in it being refused or rejected, you can request an administrative review. This must be done within 28 days of receiving the decision.
UK Visas and Immigration will go through your application again, looking at the mistake that you believe was made, and will notify you of their decision.
