How to avoid deportation from the UK

UK Deportation

If you have received a deportation order, you are advised to seek advice from an immigration solicitor as soon as you can so that an appeal can be lodged wherever possible. There are time limits for appealing, so it is important to act without delay.

What is deportation?

Deportation refers to being forced to leave the UK for the public good because you have committed a criminal offence or because you are the spouse, civil partner or child of someone who is being deported.

If it is proposed to deport you, you will receive a notice of the decision to deport you setting out why this is happening. If someone is sentenced to more than one year in prison, a deportation order is made automatically.

Appealing deportation

Appealing deportation is only possible in limited circumstances, including where the deportation would be a breach of your right to a private and family life as set out in Article 8 of the Human Rights Convention or where you are seriously ill.

The Home Office’s argument will be that it is conducive to the public good for deportation to take place.

If your prison sentence is for between one and four years, you may be able to challenge a deportation order if:

  • You parent a child aged under 18 who has lived in the UK continuously for at least seven years or who is a British citizen; and
  • You started parenting them before your immigration difficulties began
  • It would be unduly harsh for the child to live in the UK without you
  • You are integrated into the UK
  • It would be very difficult for you to integrate into the country to which it is proposed to deport you

If you have a family who are settled in the UK and who rely on you or a medical condition that is being treated in the UK but that could not be treated in the country to which you could be deported, then you may be able to make an appeal against deportation on these grounds.

Bail applications for immigration detention

If you have been detained in respect of immigration matters, you may be able to apply for bail. Our expert immigration bail solicitors can make an application on your behalf. If you have already applied for bail and it has been denied, we can apply for a review of the decision.
